Terms of Service
These Terms govern your use of Cosmify, operated by Contribute AI LLC ("Contribute AI", "we", "us"), 12234 Queenston Blvd, Ste 200, Houston, TX 77095. By creating an account or using the service you agree to these Terms.
1. Your content & your responsibility
You are solely responsible for all content you upload, generate, schedule, or publish through Cosmify ("Your Content"), including text, images, video, audio, logos, captions, and promotions.
You represent and warrant that you own or have all necessary rights, licenses, and permissions to use and publish Your Content, and that Your Content does not infringe any copyright, trademark, right of publicity, privacy, or other right of any third party, and does not violate any law.
You retain ownership of Your Content. You grant Contribute AI a limited, non-exclusive license to host, store, process, adapt, and transmit Your Content solely to operate and provide the service (including sending it to the social platforms you connect).
2. AI-generated output
Cosmify uses artificial intelligence to help create content. We do not warrant that AI output is original, accurate, non-infringing, or cleared for any use. AI may unintentionally produce material similar to existing works. You must review, edit, and clear the rights to any output before publishing it. Our optional "Copyright check" tool is guidance only and is not legal advice or a guarantee.
3. Images, music & third-party material
You must only use images, footage, music, fonts, names, and brands that you own or are licensed to use. We cannot verify the ownership or licensing of files you upload. Using copyrighted songs, characters, celebrity likenesses, or another company's trademarks without permission is your responsibility and may result in takedowns or legal claims against you.
4. Prohibited use
- Infringing intellectual property or publicity/privacy rights.
- Unlawful, deceptive, hateful, harassing, or harmful content.
- Impersonation or false claims of endorsement/affiliation.
- Violating any connected platform's terms or applicable advertising laws.
- Sexual or nude content of any kind. Cosmify is a business marketing tool, not an adult service. Generating, uploading, or attempting to generate nudity, sexually explicit, or pornographic material is strictly forbidden and is blocked by our systems.
- Violent, gory, or graphic-harm content. Do not generate, upload, or attempt to generate any image or video depicting violence, gore, blood, mutilation, weapons used to harm a person, dead bodies, self-harm, or any content promoting or glorifying harm to people. This is strictly forbidden and is blocked by our systems.
- Real-person likenesses without consent. Do not generate or upload the likeness of any real, living person — including celebrities, public figures, or private individuals — without their explicit, documented consent. You are solely liable for obtaining such consent.
- Copyrighted or trademarked characters, logos, or mascots (e.g. film, TV, game, or brand IP) without authorization.
5. AI models, avatars, video & likeness
Our AI Video Ad Studio and avatar tools generate original, fictional people and animate the product photos you provide. By using them you agree that:
- You own or are licensed to use every photo you upload, and have any depicted person's consent.
- If an AI-generated model resembles a real living person, you represent you have that person's explicit consent, and you accept full liability for use and distribution.
- You are solely responsible for how you publish and distribute the resulting content; Contribute AI is not the publisher and assumes no liability for your distribution.
- We apply automated safety filters (text and image) and block nudity, sexual content, violence & gore, real-person likenesses flagged as such, and known copyrighted characters. These filters are a safeguard, not a guarantee of legal clearance — clearing rights remains your responsibility.
- Violations are logged. Repeated or serious violations result in immediate, permanent suspension of your account without refund.
Premium generative AI video is a metered, paid feature priced in tokens (a premium clip averages ~1,000 tokens; longer or more complex renders cost more). Tokens are non-refundable once a render begins.
6. Indemnification
You agree to defend, indemnify, and hold harmless Contribute AI LLC and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the service, or your breach of these Terms — including any third-party claim that Your Content infringes their rights.
7. Disclaimers
The service and all AI output are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that content is original or cleared for use.
8. Limitation of liability
To the maximum extent permitted by law, Contribute AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from Your Content or your publishing decisions. Our total liability for any claim will not exceed the amount you paid us in the 3 months before the claim.
9. Copyright complaints (DMCA)
We respect intellectual property. If you believe content published through Cosmify infringes your copyright, see our Copyright & DMCA Policy and send a notice to our agent at admin@contributeai.org. We remove infringing material and terminate repeat infringers.
10. Termination
We may suspend or terminate accounts that violate these Terms, and remove content that we believe is infringing or unlawful.
11. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules.
